Depending on what kind of publication, I guess that could be it in some cases. Still, without knowing the source of Jeff's links, I don't know if that is the case, or if it is even true.
Many moons ago, there was a discussion on here about Ubisoft's "Red Steel". At some point I got some new info about the game in ONM and scanned in a few pages as a few people didn't believe what I was saying.
Not long after this, a few sites picked up the scans. Shortly after the image sharing account I used was purged and deleted, and I was no longer able to sign up for a new one. I take this to be because of ONM's legal gibbons getting on the case. Later after looking through the magazine I did find a small disclaimer stating that scans or copies of any of the content were treated as copyright infringement and action would be taken if discovered.
Many sites won't accept their members posting scans from English language publications - Kombo is one of them. But Kombo is happy to post foreign language scans in their news articles.
Until told otherwise, English language scans will be unacceptable, but foreign language ones will be tolerated (otherwise we on the forums would be considered hypocritical). If I'm told "no more foreign scans" then that will be enforced.
If there's any English language scans on the forums that I or any of my team have missed, then please let us know so we can get them removed, lest we become open to legal action.

Hmm, that makes sense. Check this one; it's to another board, so I'm not sure if that's an issue, but I found it while I was looking for another one. There was a thread that Erik had made about Sonic and the Black Knight, and it had mag scans, but I can't find it ATM. Maybe I was looking in the wrong spot, but if you're so inclined, it would either be in the Nintendo Discussion Board or the General Gaming Board.
Well the TMNT thread I recently made has one huge scan of the game written in English. You guys haven't mentioned anything about it yet so I'm guessing there's some sort of difference.
Perhaps there's a doublestandard when it comes to the moderation staff. As is I'm sharing it with anyone who PM or AIMs me wanting it as I think the entire rule is crap. There's no difference between an American magazine and the rest as they all have copyrights. Ban them all or ban none of them, cherrypicking is lame.
Also as far as links to links, they're legit. Back before I even admin'd this I had come across a problem over having direct scans. I looked into it and unless the law changed in the last 10years~ a link to a link to a site with the images is legal. You're not hosting it, nor are you linking to the host that has it either. All that's being done is the creation of a link to another placing linking to another place with the image. There should be no legal ramifications to that unless as I said, if the law changed in the last decade.

I don't think there's any difference since it came from gonintendo, you didn't directly scan the magazine and post it here.

Perhaps it's called being human, and not seeing it. The scan John posted will be removed too.

You're welcome to share via PM. Also, I agree with the last sentence there, but I have never really needed to deal with it, so it wasn't thought about too much. The rules thread will be changed to reflect that ALL SCANS will be removed.

Thank you for finding that out. Links to places with scans will be acceptable.
Basically the very basics of that blob I put for those who don't want to care to read it all on links to scans is very simple.
If you host them, you're busted, if you direct link to them, it's still probable to get busted (ie you post on photobucket and link it), but if you link to a place giving a link you're just linking to another site and it's ok. Now mind you if that other site has something illegal on it somewhere, then you're screwed.
