The actual game or a rom would be nice. They dont make the game anymore so the rom is legal. Thanks for your time!

No actually the rom is illegal if they don't make it or not regardless. Company still exists, copyright still exists, ...so unless they didn't renew it and it's 75 years later you're wrong. :D
